Terms and Conditions for “Best Floor Yet” Challenge.

1. Eligibility: The contest is open to end users of NGS materials who are 18 years of age or older at the time of entry. Employees of NGS, direct customers, distributors, and its affiliates, subsidiaries, advertising and promotion agencies, and immediate family members are not eligible to participate. 

2. Period: The contest begins on 8/1/2024 – and a winner is selected every 2 months. 

3. How to Enter: Participants must submit photos featuring NextGen Surfaces flooring installed along with photos of the box that it came in. Entries must be submitted via the form above by the end of every even month.  Each participant can submit only one project per entry. And one installation can only be used once. 

4. Photo Requirements: Photos must be original and taken by the participant. The photo should clearly showcase the flooring installed once the project is completed with a photo of the box and the lot number on the box. No obscene, provocative, defamatory, or otherwise inappropriate content is allowed. Photos should not infringe on the rights of any third party.

5. Judging Criteria: Photos will be judged based on creativity, originality, and how well they showcase the flooring. Judging will be conducted by our office team, and no favoritism will be allowed by anyone. All decisions of the judges are final and binding.

6. Winner Notification: One winner will be selected and notified by the start of every odd month by email and text message. If the winner does not respond within 5 business days, another winner will be selected.

7. Prize: The prize is one iWatch SE. The prize is non-transferable and no substitution will be made except as provided herein at NGS’s sole discretion.

8. Rights Granted by You: By entering this contest, you grant NextGen Surfaces the right to use your submitted photo for promotional purposes without any compensation. You represent and warrant that you own all rights to the photo you submit and that it does not violate any third party’s rights.

9. General Conditions: NGS reserves the right to cancel, suspend, and/or modify the contest, or any part of it, if any fraud, technical failure, or any other factor beyond NGS’s reasonable control impairs the integrity or proper functioning of the contest. NGS reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the contest or to be acting in violation of these Terms and Conditions.

10. Limitation of Liability: By entering, you agree to release and hold harmless NGS and its affiliates, subsidiaries, and their respective officers, directors, employees, and agents from any liability, injury, loss, or damage to person or property due in whole or in part, directly or indirectly, to the acceptance or use/misuse of a prize or participation in this contest.

11. Governing Law: The contest and these Terms and Conditions will be governed by and construed in accordance with the laws of state Florida, without giving effect to any choice of law or conflict of law rules.

12. Privacy: Information submitted with an entry is subject to the Privacy Policy stated on NGS’s website.
